Welcome to PuntosPro. These Terms of Service govern the use of our points-based loyalty platform. By creating an account, installing the app, or using any of our services, you accept these terms in full. If you don't agree, please don't use the platform.

1. What PuntosPro is

PuntosPro is a SaaS platform that lets businesses create and run points-based loyalty programs. End customers earn points by purchasing at enrolled businesses, level up tiers, and redeem rewards. PuntosPro is only the technology platform that connects customers and businesses: rewards, discounts, and experiences are offered and delivered directly by each business.

2. Business model

  • The business signs up for a monthly subscription (plans available: Starter, Pro, and Enterprise).
  • The end customer uses the app completely free. PuntosPro doesn't charge the end customer for using the platform.
  • Points, rewards, coupon books, and campaigns are configured, funded, and delivered by each business. PuntosPro doesn't guarantee the availability, quality, or actual redemption of the rewards offered.

3. User account

  • To use the platform you must create an account by providing truthful data.
  • You're responsible for keeping your password confidential. Notify any unauthorized use immediately to support@puntospro.com.
  • You may not create multiple accounts to abuse promotions, welcome points, or campaigns.
  • To create an account you must be at least 13 years old, and between 13 and 18 have your parent's or legal guardian's consent.

4. Prohibited conduct

By using PuntosPro you agree not to:

  • Forge QR codes, manipulate point balances, or attempt to compromise system security.
  • Use bots, scrapers, or any automated means to access the platform without authorization.
  • Abuse coupon books, returns, or redemptions with fraudulent intent.
  • Sell, transfer, or trade your account or accumulated points.
  • Use the platform to send illegal or offensive content or content that infringes third-party rights.

5. Points, rewards and redemptions

  • Points are a virtual unit with no monetary value and aren't redeemable for cash (except when a business explicitly enables "store credit" as an in-store credit).
  • Each business defines the earn rate, point expiration, tiers, rewards, and stock.
  • Once a reward is redeemed, the business is solely responsible for delivering it according to the conditions it has published.
  • PuntosPro may void points or redemptions obtained fraudulently or through a technical error, notifying you in advance when possible.

6. Coupon books and payments

  • When you buy a coupon book, payment is processed by MercadoPago under its own terms.
  • PuntosPro charges the business a commission on each online coupon-book sale.
  • Refund, change, or return policies for coupon books are defined by each business. PuntosPro may mediate, but the final decision belongs to the business.

7. Suspension and account deletion

We may suspend or delete your account without prior notice if we detect fraud, abuse, breach of these terms, or security risks. You can also delete your account at any time by emailing privacy@puntospro.com.

8. Intellectual property

The PuntosPro software, design, brand, logos, and content are owned by us or our licensors. You don't have the right to copy, modify, distribute, or create derivative works without our express authorization.

9. Service availability

We strive to keep the platform available 24/7, but we don't guarantee uninterrupted availability. There may be scheduled maintenance, provider outages, or force majeure events that affect the service. We aren't responsible for losses arising from reasonable interruptions.

10. Limitation of liability

The service is offered "as is", without express or implied warranties. To the maximum extent permitted by law, PuntosPro won't be liable for indirect damages, lost profits, data loss, or any harm arising from use or inability to use the platform. Our total cumulative liability is limited to the amount paid by the business in the past 12 months.

11. Changes to these terms

We may modify these terms. If changes are substantial, we'll notify you by email at least 15 days in advance. If you continue using the platform after the effective date, you accept the new terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Argentina. Any dispute related to the platform will be resolved before the ordinary courts of the City of Buenos Aires, with express waiver of any other venue or jurisdiction.
